These Terms of Service (“Terms”) govern your access to and use of the LetsWin PC Hub portal (the “Service”), operated by Let's Win Pancreatic Cancer (“Let's Win,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.
The Service is a provider-facing tool that helps healthcare professionals identify clinical trials for pancreatic cancer that may be relevant to their patients based on de-identified clinical criteria. Trial information presented in the Service is drawn from publicly available sources, including ClinicalTrials.gov, and may be incomplete, outdated, or inaccurate. The Service is provided for informational purposes only.
Access to the Service is by invitation only and is limited to healthcare professionals and authorized personnel. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We may suspend or terminate your account at any time at our discretion.
The Service is not intended to receive, process, store, or transmit protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). The Service is not designed or represented to be HIPAA-compliant, and Let's Win is not acting as a HIPAA covered entity or business associate in connection with your use of the Service.
By using the Service, you certify that you will not submit, upload, enter, or otherwise provide information that identifies, or could reasonably be used to identify, an individual patient. You further certify that any information you submit through the Service has been de-identified before submission, and that you are responsible for ensuring that your use of the Service complies with applicable law and any obligations you may have to your patients or your organization.
The Service does not provide medical advice, diagnosis, or treatment, and does not determine or guarantee patient eligibility for any clinical trial. Trial match results are informational screening aids only. All clinical decisions, including whether to refer a patient to a clinical trial, remain the sole responsibility of the treating healthcare professional. Final trial eligibility is determined exclusively by the trial sponsor and investigators.

The Service, including its software, design, text, graphics, and logos, is owned by Let's Win or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended professional purpose. No other rights are granted.
The Service relies on third-party services, including data from ClinicalTrials.gov and third-party communication providers, and may link to external websites. We do not control and are not responsible for the accuracy, completeness, or availability of third-party content or services. Clinical trial information should always be verified against the official trial record and with the trial site before acting on it.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT TRIAL INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LET'S WIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
You agree to indemnify and hold harmless Let's Win and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your submission of PHI or other prohibited information to the Service.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 4, 5, and 10 through 12) will survive.
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which Let's Win Pancreatic Cancer is organized, without regard to conflict-of-law principles.
